Before You File a Complaint
Before submitting a DMCA notice, consider whether the use may qualify as fair use (for example: criticism, commentary, news reporting, teaching, or research). If you are unsure whether material is infringing, consult an attorney before filing.
You may also contact the person who posted the content directly to resolve the issue without a formal notice.
DMCA Takedown Notice Requirements
If you are a copyright owner or an authorized agent, you may submit a written DMCA takedown notice. To be valid under 17 U.S.C. § 512(c)(3), your notice must include:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works)
- Identification of the infringing material and enough information for us to locate it (URL on AnsNew.com is required)
- Your contact information: name, mailing address, telephone number, and email address
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

What Happens After We Receive a Notice
We review each notice for completeness and validity. If a notice meets DMCA requirements, we may remove or disable access to the reported material. We may also terminate repeat infringers where appropriate.
If we remove content, we may notify the user who posted it and may share a copy of your notice (including your contact details) as required or permitted by law.
We are not required to act on incomplete or legally insufficient notices. We may refuse notices that fail to comply with the DMCA.
Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g). Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location before removal (URL)
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled due to mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which AnsNew may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent
After we receive a valid counter-notification, we may restore the removed material in accordance with the DMCA, unless the copyright owner files a court action seeking to restrain the user from engaging in infringing activity.
False Claims
Under the DMCA, anyone who knowingly misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorney fees. Do not submit false or abusive claims.
Repeat Infringers
It is our policy to terminate, in appropriate circumstances, the accounts or access of users who are repeat copyright infringers.
